Holssy Terms of Use
Article 1 (Purpose)
These Terms of Use (“Terms”) set forth the rights, obligations, and responsibilities between Holssy (“the Company”) and users (“User(s)”) regarding the use of the digital missions and community platform (the “Service”) operated by Holssy, as well as other related matters.
Article 2 (Definitions)
- “Company (Holssy)” refers to the entity that operates and manages the Holssy digital missions platform.
- “User” refers to any individual or entity who accesses or uses the Service, including both members and non-members.
- “Member” refers to a User who has completed the registration process, been granted an account (ID), and uses the Service in accordance with these Terms.
- “Content” refers to any text, photos, videos, audio, links, files, or other materials that a User posts or transmits through the Service.
- “Account (ID)” refers to the login credentials and related information granted by the Company to identify and provide access to the Service for each Member.
Article 3 (Effectiveness and Amendment of Terms)
- These Terms take effect once posted on the initial screen of the Service or via another appropriate method, or upon any additional notice provided by the Company.
- The Company may amend these Terms to the extent permitted by applicable laws and regulations. Any amended Terms will be announced with the effective date and reason for amendment, at least seven (7) days in advance (or thirty (30) days if the amendment is unfavorable to Users).
- If a User continues to use the Service after the effective date of any amendment, it is deemed that the User has agreed to the amended Terms.
- If a User does not agree to the amended Terms, the User may stop using the Service and request account deletion. The Company is not responsible for any disadvantages the User may experience from choosing not to agree with the amendments.
Article 4 (Registration and Accounts)
- A User completes registration by agreeing to these Terms and the Company’s Privacy Policy, submitting an application via the method prescribed by the Company, and receiving the Company’s acceptance of this application.
- The Company may reject or cancel registration if a User applies using false information, another person’s identity, or other fraudulent methods.
- In the event of any changes to the information a User provided at the time of registration (e.g., email address, contact information), the User must promptly update such information via account settings or notify the Company’s customer support.
Article 5 (Use of the Service)
- Users may freely use the Service within the scope of these Terms, the Company’s policies, notices, and any applicable laws and regulations.
- The Company provides various features to facilitate communication, content sharing, project support, digital missions, and more. Users can perform desired activities through these features.
- The Company may change or discontinue all or part of the Service due to technical requirements or operational policies and will make reasonable efforts to notify Users in advance.
Article 6 (User Responsibilities)
- Users shall not engage in any of the following activities when using the Service:
- Infringing upon the rights, reputation, credit, or other legitimate interests of the Company, other Users, or any third party.
- Violating any intellectual property rights, portrait rights, personal information, or other rights of the Company, other Users, or third parties.
- Providing false information, misrepresenting identity, impersonating another person, or creating multiple accounts fraudulently.
- Posting or transmitting content deemed offensive, including stalking, abusive language, obscene or violent content, or other materials widely considered inappropriate by social norms.
- Without prior permission from the Company, posting or transmitting commercial advertisements, promotions, spam, or any content primarily intended for profit.
- Interfering with or intentionally disrupting the operation of the Service (e.g., server attacks, unauthorized crawling, malicious code distribution).
- Any other acts violating applicable laws, public order, social norms, or the Company’s policies.
- Users must comply with these Terms, related laws and regulations, as well as the Company’s policies and notices concerning the Service.
Article 7 (Content Rights and Responsibilities)
- In principle, all intellectual property rights to Content posted or transmitted by a User belong to that User.
- The Company may use Content posted by Users worldwide, on a non-exclusive and royalty-free basis, but only to the extent necessary for the operation, improvement, or promotion of the Service (for example, displaying the Content within Service features or promoting related events). If the Company intends to use Content in any manner beyond the scope described here, it will obtain prior consent from the User.
- If Content is found to violate these Terms, the Company’s policies, or relevant laws and regulations, or if a legitimate complaint is raised by a third party, the Company may remove or restrict access to such Content without prior notice.
- Users must ensure that the Content they post does not infringe on third-party rights, such as copyrights or portrait rights. Users bear full responsibility for any disputes or damages arising from such infringements.
Article 8 (Protection of Personal Information)
- The Company processes Users’ personal information lawfully and safely in accordance with applicable data protection laws and its Privacy Policy.
- If a User’s personal information changes (e.g., contact details), the User must promptly update the information or follow the procedures set by the Company to correct it.
- While the Company makes every effort to protect personal information, it does not take responsibility for information that Users themselves disclose or share with others.
Article 9 (Restrictions on Use and Termination)
- The Company may restrict a User’s use of the Service, delete an account, remove Content, or take other actions if the User violates these Terms, the Company’s policies, or applicable laws, or otherwise interferes with the Company’s business.
- A User may at any time terminate the Service by deleting their account. In this event, the Company shall handle the User’s personal information in accordance with relevant laws and its Privacy Policy.
- If the Company restricts access to the Service or the User’s account, the Company will notify the User via email, in-app notification, or other suitable methods, including the reason for the restriction, its scope, and how the User can object to the restriction.
Article 10 (Disclaimer)
- The Company is not liable for any inability to provide the Service due to force majeure events (including, but not limited to, natural disasters, war, terrorism, strikes, and governmental orders).
- The Company does not guarantee the reliability or accuracy of information, data, or content posted by Users, and the User posting such materials assumes all liability for them.
- The Company has no obligation to intervene in disputes arising between Users or between a User and a third party and shall not be liable for any damages resulting from such disputes.
- The Company shall not be responsible for any damages arising from data loss, service interruptions, or system errors, unless caused by the Company’s intentional or grossly negligent act.
Article 11 (Dispute Resolution and Governing Law)
- The Company and Users shall try to resolve any disputes that may arise from the use of the Service through mutual, good-faith discussions.
- If a dispute cannot be resolved through negotiation, it may be submitted to a court of competent jurisdiction in accordance with the relevant civil procedures and laws.
- These Terms and any disputes related to the Service shall be governed by the laws of the Republic of Korea (or another applicable jurisdiction, as the Company may designate).
Article 12 (Miscellaneous)
- Matters not stipulated in these Terms or interpretations thereof shall follow applicable laws, commercial practices, and the Company’s operational policies.
- The Company may establish separate operational policies or guidelines (such as event or campaign guidelines) for specific features, and such policies shall prevail over these Terms in case of conflict.
- Even if the Company does not enforce a provision of these Terms, this shall not constitute a waiver of the Company’s right to enforce it at a later time.
Addendum
- (Effective Date) These Terms of Use shall come into effect on 1/1, 2025.
